Petitioner apprehends his arrest in a case registered under section 302/34 of the Indian Penal Code. Allegation against the petitioner is that he killed Md. Aslam , husband of the informant by assaulting him and thrown his dead body in Badhar/ Khanda.

On behalf of the petitioner it is submitted that petitioner has got no criminal antecedent. It is further submitted that from perusal of the first information report it is evident that petitioner has been implicated in this case merely on suspicion. There is no direct or indirect evidence against him. On behalf of the State it is submitted that

Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, Jehanabad in Ghosi P.S. (Okri O.P) P.S. Case no. 52/15, subject to the conditions as laid down under section 438(2) Cr.P.C. (Sudhir Singh, J) M.Rahman/- U T
