The petitioner seeks bail in Madhuban P.S. Case No. 130 of 2016 registered under Sections 363, 366, 366A and 34 of the Indian Penal Code.
The informant alleged that the petitioner and his family members had threatened to teach a lesion on account of land dispute. On 14.05.2016, his daughter had gone to fill up the form of examination, but she did not return. It is alleged that all the accused persons kidnapped his daughter.
Leanred counsel for the petitioner submits that the entire family members have been made accused. The victim was recovered and she disclosed that the petitioner and others
Patna High Court Cr.Misc. No.21130 of 2017 (2) dt.10-05-2017 2/2 kidnapped her, but she did not make any specific allegation against the petitioner. Petitioner and others are the neighbours of the informant and they have compromised the case. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is in jail since 16.10.2016, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Motihari in connection with Madhuban P.S. Case No. 130 of 2016.
