====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 28-03-2016 Sri S.D. Sanjay, learned senior counsel, appearing on behalf of the petitioner, submits that initially the present writ petition was filed for quashing of disciplinary proceeding against the petitioner, which according to learned counsel for the petitioner was in teeth of the order passed by L.P.A. Court. However, during the pendency of the writ petition final order in departmental proceeding has been passed and petitioner has been terminated from service.
In view of the facts and circumstances, the court considers that now the writ petition has become infructuous. The
Patna High Court CWJC No.13778 of 2011 (9) dt.28-03-2016 2/2 petitioner, if so advised, may assail the order of termination in a separate proceeding. He shall be at liberty to raise all the points. The writ petition stands disposed of with liberty as indicated above.
