JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in connection with Sessions Trial No. 255 of 2016 arising out of Sikandra P.S. Case No.90 of 2016 instituted for the offence under Sections 364/34 of the Indian Penal Code. Subsequently, Sections 302 and 201 of the Indian Penal Code was added.
The First Information Report is against unknown. The informant has alleged that her husband has either been kidnapped or some unforeseen occurrence has taken place with him. From the impugned order it appears that name of this petitioner has transpired on the basis of disclosure made by spy. From the impugned order it appears that one spy in paragraph-43 of the case diary disclosed the name of one Trilouki Kora and
Patna High Court Cr.Misc. No.24259 of 2017 (2) dt.24-05-2017 2/2 said Trilouki Kora in his statement made in paragraph-45 of the case diary, has taken the name of this petitioner. From the impugned order it appears that besides such material, there is no any allegation of specific overt act against the petitioner.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Jamui, in connection with Sessions Trial No. 255 of 2016 arising out of Sikandra P.S. Case No. 90 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
