Learned counsel for the petitioner is granted liberty to make necessary correction in paragraph 26 of the petition. The petitioner apprehends his arrest in connection with Chandi P.S. Case No. 110 of 2015 registered for the offences punishable under Sections 420, 406 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation made against him is for defalcation of paddy to the tune of Rs. 99,68,763.40/-. It is further submitted that the petitioner has already pledged the properties to the tune of Rs. 49 lacs and though he had been repeatedly requesting the BSFC to lift the rice in lieu of the paddy, received by him.
Patna High Court Cr.Misc. No.29157 of 2015 (3) dt.09-09-2015 BSFC consistently defaulted in lifting the same resulting in loss to the petitioner. It is further submitted that petitioner is facing PDR proceeding also.
Considering the aforesaid submissions and also the fact that petitioner has pledged the properties as well as petitioner is facing PDR proceeding, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Hilsa, Nalanda in connection with Chandi P.S. Case No. 110 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C. (Anjana Mishra, J) Jagdish/- U T
