JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-06-2017 Heard Shri Ashhar Mustafa, the learned advocate for the petitioner and learned APP for the State. The petitioner in the present case is seeking regular bail in connection with Rail Darbhanga (Sitamarhi) P.S. Case No. 17 of 2017 registered for the offences under Section 370/34 IPC read with section 79 of the Juvenile Justice Act, 2015. The allegations as disclosed in the First Information Report would show that the case has been instituted on the fardbeyan of the Assistant Sub Inspector who intercepted 20 children. The allegations are that this petitioner was involved in child trafficking from Sitamarhi to Ludhiana and Jalandhar. The learned counsel for the petitioner would submit
Patna High Court Cr.Misc. No.23264 of 2017 (3) dt.07-06-2017 that the petitioner has been arrested on mere suspicion without there being any cogent material. He has drawn my attention towards the affidavits said to have been sworn by the parents of Pankaj Manjhi, Ladoo Kumar and Dhiraj Kumar showing that the children were going with petitioner to meet their parents who were working at Ludhiana. He would further submit that the petitioner is in custody since 20.2.2017 and the investigation is already over and further detention would be only by way of punishment which need not be there in the facts of the case. The learned APP opposed the prayer for bail.
However, apart from the above, no other material could be placed to substantiate the allegation.
In the aforesaid facts and circumstances stated hereinabove, let the petitioner, namely, Daud Ansari be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Railway, Samastipur in connection with Rail Darbhanga (Sitamarhi) P.S.
