JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Hasanpur P.S. Case No. 12 of 2015 for the offences instituted under Sections 25(1-B)A/26/35 of the Indian Penal Code. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the accused persons have been caught raid handed along with the looted motorcycle and ammonization and both have confessed their guilt and stated that they were going to commit crime and also stated the name of the petitioner.
It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner and he has not been arrested on the spot. It is submitted that the
Patna High Court Cr.Misc. No.27922 of 2015 (2) dt.22-07-2015 2/2 petitioner has been falsely implicated in the present case by the coaccused with whom there is an inimical terms. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstance, I am not inclined to grant bail to the petitioner. Accordingly, this application is rejected.
If anyhow the petitioners will surrender before the court below within a period of four weeks from today, the court below shall consider the case of the petitioner on its own merit without being prejudiced by this order and if possible, the same will be disposed of on the same day.
