The petitioner seeks bail in connection with S. Tr. No.- 464/2019 arising out of Minapur P.S. Case No.296 of 2004, registered for the offence punishable under Section 396 IPC. Vide order dated 08.09.2021, a report was called in this case regarding the stage of trial. In compliance thereof, a report dated 20.09.2021 has been sent by learned 15th Additional District and Sessions Judge, Muzaffarpur, which is kept at Flag 'P' stating therein that supplementary charge-sheet has been submitted against the petitioner and only supplementary case diary is available on record. A letter has also been written to S.S.P., Muzaffarpur for supply of photocopy of original case diary on 05.07.2021 but the same has not been furnished yet.

Patna High Court CR. MISC. No.50052 of 2021(3) dt.06-10-2021 2/2 Summons have been sent to the witnesses but till now no witness has turned up for examination due to Covid lock-down. Considering the aforesaid facts, the prayer for bail of the petitioner made through the instant bail application is hereby rejected.

However, the learned trial court is directed to conclude the trial as expeditiously as possible, preferably within a period of six months from today.

The Senior Superintendent of Police, Muzaffarpur is directed to take steps for production of the prosecution witnesses for their examination as and when the date is fixed by the court below, so that the trial may be concluded within the time indicated herein above.

In the event, the prosecution witnesses fail to appear before the court below, it would deem to be the violation of the direction of this Court and, accordingly, contempt proceeding will be initiated against the concerned person/official.
