JUSTICE SUDHIR SINGH ORAL ORDER 14-05-2015 The petitioner is apprehending his arrest in connection with Kishanganj Mahila P.S. Case No. 64 of 2014 for the offences instituted under Sections 341, 323, 498(A), 506 and 509 of the Indian Penal Code.

Heard learned counsel for the petitioner, State and learned counsel for the informant.

The prosecution story, in brief, is that the husband and in-laws of the informant Babbi Kumari subjected her to cruelty for demand of dowry and in default they assaulted her and ousted from the matrimonial house.

It has been submitted on behalf of the petitioner that the petitioner is ready to keep the informant with full dignity. It has

No.656 of 2015 (3) dt.14-05-2015 2 / 2 further been submitted that in case the informant is not ready to stay with the petitioner in that situation, the petitioner shall deposit amount of Rs. 5,000/- per month in the court below and the same shall be released in favour of the informant. On behalf of the State, it has been submitted that the petitioner is the husband of the informant and specific allegation has been made against him.

Considering the fact that if the informant is not ready to stay with the petitioner then in such situation, the petitioner shall deposit amount of Rs. 5,000/- per month in the court below which shall be released in favour of the informant, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Kishanganj Mahila P.S. Case No. 64 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Kishanganj, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
