Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner is in jail custody since 04.09.2013 in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B/34 of the Indian Penal Code on the accusation that he gave fabricated and forged documents to informant and also took huge amount from him. The learned trial court has reported vide his letter no. 568 dated 07.11.2015 that up till now police paper could not be furnished.

No.20777 of 2015 (5) dt.26-11-2015 2/2 Learned counsel for the informant submits that petitioner is a habitual offender and as a matter of fact, near about four cases of cheating have been instituted against him. Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Hawai Adda P.S. Case No. 40 of 2013, subject to condition that one of the sureties must be close relative of the petitioner and holder of landed property and the aforesaid surety shall swear an affidavit disclosing this fact as to how he is related with the petitioner.
