The Petitioner apprehends his arrest in a case instituted for the offence under Section(s) 302/34 Indian Penal Code.

It has been submitted that the Petitioner has been implicated in a patently false case since it is quite improbable that any person would be administered poison in a public place without any resistance.

Considering that the Petitioner is named in oral dying declaration notwithstanding the fact that the case was found false during investigation for whatever reason, I am not inclined to extend the privilege of anticipatory bail to the Petitioner in connection with Complaint Case No.1710 C/11 arising out of Barhat (Malaypur) P.S. Case No.73 of 2007,

Patna High Court Cr.Misc. No.748 of 2015 (2) dt.16-01-2015 2/2 pending in the court of Sri Sharad Chand, Judicial Magistrate, 1st class, Jamui.

Prayer for anticipatory bail is rejected.
