2. The petitioner apprehends his arrest for the offences alleged under Sections 467, 468, 471, 120B, 406 and 420 registered in connection with Madanpur P.S. Case No. 27 of 2015.
3. It is submitted that the petitioner has been falsely implicated on suspicion. It is further submitted that similarly situated co-accused, being the owners of other trucks, namely, Meena Devi and Nesar Alam have been granted anticipatory bail in Cr. Misc. No. 28369 of 2015. So also, co-accused Salahuddin Warsi has been granted provisional anticipatory bail in Cr. Misc. No. 33123 of 2015.
4. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner's arrest or
Patna High Court Cr.Misc. No.27432 of 2015 (4) dt.29-04-2016 2/2 surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on provisional anticipatory bail for four months on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S. Case No. 27 of 2015, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
5. The provisional bail of the petitioner will be confirmed on verification of the fact that the trucks in question were validly registered and insured on the date of seizure, otherwise the petitioner will surrender or pray for regular bail. (Vikash Jain, J) B.T/- U T
