The petitioner seeks regular bail in connection with Ghorasahan P.S. Case No.87 of 2016 registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code. As per written report the informant has alleged that on 28.03.2016 at about 12:00 noon this petitioner and 4-5 others have kidnapped the sister-in-law of informant. It has been submitted that the victim is a resident of Delhi and she was residing with the informant and his family members. She had no occasion to visit the village of informant and so she had no reason to identify any of the accused including this petitioner. It has been submitted that the present

Patna High Court Cr.Misc. No.30153 of 2018 (3) dt.03-07-2018 case has been lodged with false and frivolous allegation on account of village politics. The statements recorded under section 164 of Cr.P.C. are contradictory to the statements made in the F.I.R. The petitioner is in custody since 14.03.2018 having clean antecedent and so he deserves bail.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M., Sikrahta Dhaka, East Champaran in connection with Ghorasahan P.S. Case No.87 of 2016.
