The writ application has been filed in the representative capacity for quashing of the communication dated 17.08.2006 issued by the Block Education Extension Officer, Kalyanpur Blcok as well as the Block Development Officer, Kalyanpur to the office of the District Superintendent of Education in respect of entry no.18 only which relates to selection of a piece of land/plot for construction of a primary school. Where the school should be constructed, is an issue raised through this writ application.

Patna High Court CWJC No.19349 of 2011 (3) dt.24-11-2015 2/2 A counter affidavit has been filed on behalf of respondent nos. 5 and 7 in which relevant facts concerning selection of the land/plot has been detailed. The statement made in paragraph 6, in particular, has been placed before me in order to justify the selection of the land/plot for construction of the primary school in question in the said block.

This is an issue which should not be gone into by a writ court. The writ application merits to be dismissed. I order accordingly.
