The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363, 366A, 120B, 34 of the Indian Penal Code.
Accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. the victim got her age recorded as 18 years. The victim stated that she went in the company of Shambhu Sahni non-petitioner with her own and performed married with him. The victim has not named the petitioner. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Piprakothi P.S. Case No.37 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
