JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-7 of Essential Commodities Act.

240 bags of rice were seized from godown of the petitioner and it is alleged that the aforesaid bags of rice had been kept by the petitioner for black-marketing and, as a matter of fact, the aforesaid seized bags had been lifted from the godown of Bihar State Food Corporation.

Submission on behalf of petitioner is that the informant levelled the above-said allegation only on the basis of sticker of PACKS pasted on some of the bags but the informant failed to understand this fact that the bags are available in open

Patna High Court Cr.Misc. No.37106 of 2016 (2) dt.06-09-2016 2/2 market. It is further submitted that the petitioner has purchased the said rice which is evident from perusal of Annexure-2 series. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mojahidpur P.S. Case No. 115 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
