The petitioner is accused in connection with Belhar (Kheshar O.P.) P.S. Case No. 316 of 2016 registered under Section 412/34 of the Indian Penal Code.

The accusation is that on seeing police party, one person, who was driving the motorcycle, started to flee away, but he was apprehended, who disclosed his name as Jitendra Singh @ Vipul Singh (petitioner) and on interrogation, he did not produce the papers regarding the motorcycle and also disclosed that the motorcycle is stolen one, which is handed over by his friend Sinku Pathak @ Rahul @ Baba to him.

Patna High Court Cr.Misc. No.1478 of 2017 (2) dt.18-01-2017 Learned counsel for the petitioner submits that, in fact, petitioner took motorcycle from his friend Sinku Pathak @ Rahul @ Baba and the same motorcycle was recovered by the police, which was stolen motorcycle but the petitioner has no knowledge to the effect that the said motorcycled was stolen. It is further submitted that petitioner has no criminal antecedent and he is in custody since 04.10.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Belhar (Kheshar O.P.) P.S. Case No. 316 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
