For the Petitioner/s : Mr Anil Kumar Saxena, Advocate For the S t a t e : Mr Shyam Bihari Singh, APP ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 03-05-2018 Heard learned counsel for the petitioners and the APP for the State.

Petitioners seek bail in a case registered under Sections 302, 201/34 of Indian Penal Code.

It is submitted by the petitioners' counsel that though there is no eye witness to the occurrence, the petitioners have been named in this case only on the basis of suspicion. It appears from the case diary, which has been called for earlier by this Court, that witnesses have supported the allegation of assault against the petitioners. Earlier also, the victim had lodged Bhadwar Police Station Case No 2 of 2016 against the instant petitioners.

Patna High Court Cr.Misc. No.17757 of 2018 (3) dt.03-05-2018 2/2 Considering the nature of allegations against the petitioners, this Court, for the present, is not inclined to allow the petitioners' prayer for bail. The same is rejected. (Madhuresh Prasad, J) M.E.H./- U T
