2. The petitioner is in custody in connection with Mabbi P.S Case No. 35 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 76, 77, 64 and 352 of the BNS Act.

3. As per allegation in the FIR, petitioner has established physical relation with the informant and recorded the intimate scene and made it viral.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that there is no direct evidence against the petitioner that he has viral the video of the informant rather only suspicion was raised against the petitioner. Moreover, the occurrence took place six months earlier but FIR has been lodged after six

Charge-sheet has already been submitted, He further submits that after completion of investigation, police submits that case is not found to be true under Section 64 of the BNS. He next submits that petitioner is in judicial custody since 11.03.2025 having clean antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, entire case diary, impugned order dated 05.05.2025, it appears that investigating officer has found the case under Section 64 of the BNS not true and FIR has also lodged after six months of delay and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Mabbi P.S Case No. 35 of 2025.
