JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against petitioner is to have killed husband of informant by hanging.

It has been submitted on behalf of petitioner that he is in custody since 31.8.2016. Chargesheet has been submitted against petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has been named in the F.I.R. merely on the basis of suspicion. There is no substantive evidence to suggest implication of petitioner in the present case. Other co-accused have been granted bail vide Cr. Misc. no. 394 of 2016 and Cr. Misc. no. 16003 of 2016. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
