Petitioner seeks regular bail in connection with Sambhuganj PS Case No. 205 of 2018 , Registered No. 3134 of 2018 registered for the offence punishable under Section 379 of the IPC.
As per the prosecution case some unknown thieves stolen the motorcycle of the informant standing in front of his house.
Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has been made accused on the basis of his confessional statement. He next submits that stolen motorcycle has been recovered from the garage of the son of the
Patna High Court CR. MISC. No.50475 of 2021(3) dt.05-05-2022 2/2 petitioner.
On the other hand, learned counsel for the State referring to case diary submits that petitioner, his son and one other accused have formed a gang and have been indulged in the theft of motorcycle and other articles and the stolen motorcycle in question has been recovered from the house of the petitioner which would be evident from the seizure list. The petitioner has got criminal antecedent also inasmuch as three other cases of similar nature have been registered against him. Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioner has got criminal antecedent of similar nature of offence and the stolen motorcycle in question has been recovered from the possession of the petitioner, as such, I am not inclined to grant regular bail to the petitioner at this stage. The prayer for grant of bail is rejected.
However, the petitioner may renew his prayer for bail after three months from today if the trial does not register any progress.
