JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2017 The petitioners seek regular bail in connection with Mohiuddin Nagar P.S. Case No. 24 of 2017, registered for offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 302, 338 and 452 Indian Penal Code.
Allegation as per F.I.R against the petitioners that they along with several others has assaulted the informant and his wife in which wife of the informant received brick injury due to which she became unconscious and fell down and later on succumbed to her injuries.
It has been submitted on behalf of the petitioners that only general and omnibus allegation has been levelled against the
Patna High Court Cr.Misc. No.21888 of 2017 (3) dt.19-06-2017 2/3 petitioners and no specific allegation has been attributed to any of the petitioners. Further there is case and counter case between the parties and now petitioners have remained in judicial custody for more than four month.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that no specific allegation has been levelled against the petitioners and petitioners have no criminal antecedent and have remained in judicial custody for more than four months, as such, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM -IV, Samastipur, in connection with Mohiuddin Nagar P.S. Case No. 24 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves
Patna High Court Cr.Misc. No.21888 of 2017 (3) dt.19-06-2017 3/3 available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of their bail bonds.
