2. The petitioner seeks bail in connection with Adhoura P.S. Case No. 42 of 2023, registered for the offences punishable under Sections 25(1-aa), (1-b)a, 26, 35 of the Arms Act and Sections 13, 18 and 19 of Unlawful Activities Prevention Act.
3. As per the prosecution case, on the disclosure made by co-accused, house of petitioner was searched and several literature, pamphlet, contribution receipts meant for collecting contribution to operate naxal activity in the area were recovered from his house.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.44653 of 2024(3) dt.18-10-2024 2/2 present case merely on the confessional statement of co-accused Vijay Shankar Singh. Petitioner was not arrested on spot. No incriminating article has been recovered from the conscious possession of the petitioner. The charge-sheet has already been submitted. Petitioner is in custody since 22.03.2024.
5. Learned A.P.P. appearing on behalf of the State opposed the prayer for bail.
6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Kaimur at Bhabua in connection with Adhoura P.S. Case No. 42 of 2023.
