The petitioner is apprehending his arrest in a case instituted under Sections 386, 467, 468, 471, 420 and 120B/34 of the Indian Penal Code.

It is alleged by the informant that the informant is the driver of truck and when he was taking the goods loaded in his truck through the road of Jharkhand and this petitioner with the members of the gang compelled him to take fabricated documents from him on payment of certain amounts.

It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent. Petitioner is the owner

Patna High Court Cr.Misc. No.28519 of 2015 (3) dt.01-10-2015 of the petrol pump at the G.T. road. The present prosecution brought against him at the instance of the local police station against whom the petitioner had made a number of representations before the Superintendent of Police, Gaya and DIG which is Annexure-3 to the supplementary affidavit. The local police in retaliation to the representations made by the petitioner got one Amas P.S.Case No.80 of 2015 instituted against the petitioner and other.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati, Gaya in connection with Sherghati (Dhobi) P.S.Case No.135 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
