The petitioners figured as accused in Masaurhi P.S. Case No.205 of 2013, wherein offence punishable under Sections 307 of the Indian Penal Code and Section 27 of the Arms Act was alleged. The case is pending in the court of S.D.J.M., Masaurhi, Patna.

Patna High Court Cr.Misc. No.54124 of 2013 (7) dt.09-04-2015 2/2 Apprehending arrest, earlier the petitioners had approached the court of the Sessions Judge, Patna by filing A.B.P. No.5617 of 2013. The same was dismissed on 6.12.2013. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C.

Heard learned counsel for the petitioners and learned A.P.P. for the State.

The allegations against the petitioners are serious in nature. It is stated that seven persons attacked, three used firearms and the bullet fired at by the 6th petitioner has hit the leg of the informant.

Considering the serious nature of the offence, the question of granting anticipatory bail does not arise. This application is dismissed.
