Petitioner is in custody in connection with Neemachandpura P.S. Case No. 95 of 2018 for the offence under section302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is 70 years old having no criminal antecedent. Referring to prosecution case, he submits that allegation of assault is against Shyam Paswan and not against this petitioner.

Considering the fact that petitioner has no criminal antecedent and there is no allegation of assault against him rather the direct allegation of assault is against Shyam Paswan, the Court is inclined to grant bail to the petitioner, let the
