This is an application for grant of regular bail for offences punishable under Sections 25(1-b)A, 26 of the Arms Act. It has been submitted on behalf of the petitioner that though it is alleged that one country made rifle has been recovered from the house of petitioner, but the seizure list itself shows that the rifle was not in working condition. It has further been submitted that the petitioner has remained in custody for more than three months.

Having heard both sides. In view of the fact that petitioner has no criminal and has remained in custody for more than three months and the rifle, which has been recovered was
Patna High Court Cr.Misc. No.55508 of 2016 (2) dt.23-12-2016 2/2 found in unusable condition, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M - X, Gaya, in connection with Fathpur P.S. Case No. 240 of 2016.
