2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Dhaka P.S. Case No. 158 of 2023, lodged on 03.04.2023, under Sections 409/406/420/34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against six named accused persons including the present petitioner with
Patna High Court CR. MISC. No.41486 of 2026(2) dt.01-07-2026 2/3 allegation that they have not completed the work and grabbed huge money of Chief Minister's Nal Jal Yojana.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the criminal antecedent of the petitioner is clean. Counsel submits that petitioner has already completed the work. He further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon her.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is no document on record by which it can be ascertained that work has been completed or not?

As such, in the present facts and circumstances of this case, let the above named petitioner be released on provisional anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Dhaka P.S. Case No. 158 of 2023, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.

7. The provisional anticipatory bail shall be confirmed only upon the production before the Trial Court, within 90 days from the date of furnishing the bail bond, of a certificate issued by the Block Panchayat Raj Officer, Dhaka, East Champaran, certifying to his satisfaction that the work in respect of which the case has been instituted has been completed. In the event that such certificate is not produced within the stipulated period, the Trial Court shall be at liberty to cancel the bail bond of the petitioner. (Dr. Anshuman, J) Mkr./Rakesh/- U T
