The petitioner seeks bail in connection with Paharkatta P.S. Case No.36 of 2016/G.R. No.1168 of 2016 registered under Section 272 of the Indian Penal Code besides Section 47A of the Bihar Excise (Amendment) Act, 2016.

The accusation is of recovery of 43 bottles, each containing 180 ml. Indian Made Foreign Liquor, from the old wine shop of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and is in custody since 12.09.2016.

Having regard to the facts and the circumstances of the

Patna High Court Cr.Misc. No.49810 of 2016 (4) dt.27-01-2017 2/2 case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Kishanganj, DisatrictKishanganj, in connection with Paharkatta P.S. Case No.36 of 2016/G.R. No.1168 of 2016.
