This is a petition for grant of regular bail for offences under Sections 272, 273 and 34 of the Indian Penal Code and 30(a), 38 and 41 of the Bihar Excise Act, 2016.
The recovery of liquor was from near the house and cattle yard of some other co-accused. The petitioner has sated on oath that he has got no criminal antecedent and is in custody since 09.03.2017.
Submission of the petitioner is that some other person has stated before the police that the petitioner was found carrying the liquor in a drum though nothing has been recovered from the possession of the petitioner or from the house of the petitioner.
Patna High Court Cr.Misc. No.22051 of 2017 (2) dt.08-05-2017 2/2 Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Taraiya P.S. Case No. 11 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, IX, Saran at Chapra, or successor Court.
