JUSTICE SANJAY PRIYA ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Garkha P.S. Case No. 286 of 2016 instituted for the offence under Sections 399, 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act. It has been submitted that petitioner is in custody since 15.9.2016. There is allegation that one automatic pistol loaded with five cartridges has been recovered from possession of this petitioner.

From the impugned order it appears that the charge sheet has already been submitted but the trial of the accused has not been started.

Therefore, keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed.

Patna High Court Cr.Misc. No.23697 of 2017 (3) dt.23-05-2017 2/2 Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 11th Additional Sessions Judge, Saran at Chapra, in connection with Garkha P.S. Case No. 286 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. The petitioner in any manner will not try to hamper the trial by intimidating or influencing the witnesses and will remain present on each and every date of trial. Any two subsequent defaults will result in cancellation of bail bonds in the court below.
