JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is apprehending his arrest in connection with Malsalami P.S. Case No. 227 of 2014 for the offences instituted under Sections 341/323/326/307/506/34 of the Indian Penal Code.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that when the informant along with his daughter and Nati was going and reached near tempo stand near Malsalami Police Station, petitioner intercepted the informant and asked withdraw the previous case, otherwise he will finish you, altercation occurred and assault took place resulting injuries to the informant.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.27141 of 2015 (2) dt.21-07-2015 2/2 the petitioner has been falsely implicated in the present case. It is further submitted that the injury report indicates that the nature of injury is simple.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Malsalami P.S. Case No. 227 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Patna City, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
