Petitioner is accused in connection with Bahera P.S. Case No. 59 of 2016 registered under Sections 147, 148, 341, 323, 324, 307, 354 of the I.P.C. and later on, section 302 of the I.P.C. was added.

The allegation is that the accused persons surrounded and assaulted the victim, as a result of which, she died. Submission is that petitioner is not named in the F.I.R. and there is no direct allegation against the petitioner. Further submission is that similarly situated co-accused person namely, Madan Paswan has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 51949 of 2016. Petitioner is in

Patna High Court Cr.Misc. No.48769 of 2016 (3) dt.02-02-2017 2/2 custody since 28.05.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Benipur, Darbhanga in connection with Bahera P.S. Case No.59 of 2016.
