JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 448, 307, 324, 34 of the Indian Penal Code and Section 3/5 of Explosive Substance Act. It is a case of misuse of privilege of bail for more than 15 years and petitioner appears to have been declared absconder in the year 2006 but co-accused, having similar case, has already been granted privilege of bail by this court and, therefore, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Asst. Sessions Judge-II, Jamui in connection with Sessions Trial No. 450(A) of 1995

Case No. 93 of 1994, subject to condition that he shall attend the trial court on each and every date in person for the period of six months or till conclusion of his trial whichever is earlier and if he fails to do so on three consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
