The petitioner seeks bail in Sadar P. S. Case No. 82 of 2019 instituted for the offence under Section(s) 302 and 201/34 of the Indian Penal Code.

Learned counsel for petitioner submits that petitioner is not named in the written report. There is no eye witness to the occurrence. The name of this petitioner has come during investigation in the confessional statement of co-accused Meena Devi.

In the written report it is alleged that informant learnt that dead body of his brother, namely, Md. Rehan has been thrown in the orchard after committing his murder. The dead body was seen by the police officer in presence of informant.

The informant has raised suspicion against four persons as named in the written report. Petitioner is not named in the written report. The name of petitioner transpired in the instant case on the basis of confessional statement of co-accused Meena Devi. Petitioner is in custody since 17.2.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Purnea in connection with Sadar P. S. Case No. 82 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
