2. Petitioner seeks bail who is in custody since 08.04.2026 in connection with Barahiya P.S. Case No. 57 of 2026 for the offences punishable under Sections 126(2), 115(2), 109(1), 352, 351(2), 3(5) of the B.N.S., 2023.

The case of the prosecution is based on computerized typed report dated 08/03/2026 of one Raushan Kumar in which it is alleged that on 04/03/2026 at about 01.30 pm, his brother Aman Kumar aged about 14 years was at his Bungalow and taking bath then co-accused Anil Singh and the petitioner came there and started abusing and assaulting by fist and slap. Further, the petitioner assaulted the brother of the informant by means of iron rod brutally as a result he sustained injury and became senseless. The occurrence took place due to

Patna High Court CR. MISC. No.42853 of 2026(2) dt.06-07-2026 2/3 dispute in between the children. On information given by the villagers, the informant brought his brother in Mamta Emergency Hospital and due to serious condition, the delay caused in giving the information.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. It is next submitted that it appears from the FIR that allegation against the petitioner is that he has assaulted to the brother of the informant, namely, Aman Kumar by means of iron rod and he has received the injury. Learned counsel for the petitioner next submits that the injury sustained to Aman Kumar is simple in nature caused by hard and blunt substance. Learned counsel for the petitioner next submits that police after investigation has submitted charge-sheet and petitioner is in custody since 08.04.2026.

5. The learned Additional Public Prosecutor for State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances and the fact that injury sustained by Aman Kumar is simple in nature, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned

Patna High Court CR. MISC. No.42853 of 2026(2) dt.06-07-2026 3/3 Additional Chief Judicial Magistrate-Ist, Lakhisarai or its successor court in connection with Barahiya P.S. Case No. 57 of 2026, subject to the following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be canceled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
