Petitioner seeks regular bail in connection with Beldaur PS Case No. 23 of 2021 registered under Sections 25 (1-b)a / 26 of the Arms Act.

Police has allegedly recovered a loaded country made pistol and two live cartridges from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case inasmuch as from perusal of the seizure list it is evident that illegal fire arm has been recovered from near a Baandh and not from the conscious possession of the petitioner. Learned counsel next submits that petitioner was not having any criminal antecedent however after arrest of the petitioner in the present case, he has been made accused in Beldaur PS Case No. 339 / 2020,

Patna High Court CR. MISC. No.50477 of 2021(2) dt.25-03-2022 2/2 petitioner is in custody for about more than one year since 5/2/2021 and charge sheet has already been submitted. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 5.2.2021, charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence if released on bail, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Beldaur PS Case No. 23 of 2021 on the following condition:

(a) that the petitioner shall remain present on each and every date during the course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled.
