JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 03-09-2025 At the outset, learned counsel for the petitioner submits that the petitioner no. 1, Asha Devi has already been granted bail by a co-ordinate Bench of this Court vide order dated 25.06.2025.
2. Heard learned counsel for the petitioner and learned APP for the State.
3. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 120B/34 of the Indian Penal Code.
4. The case of the prosecution, in short, is that the petitioner along with others have killed her husband on account of land dispute.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that Ramchandra Sahani, the petitioner herein is about 65 years of age and is the father of the deceased. It is also submitted that coaccused persons, namely, Pranav Sahana @ Krishna Sahni has been granted bail by a co-ordinate Bench of this Court vide order dated 18.01.2023 passed in Cr. Misc. No. 74318 of 2022. It is further submitted that from perusal of the order of the trial Court, it transpires that the cause of death is hanging whereas from perusal of the FIR, it is clear that the allegation is that they have strangulated the husband of the informant. It is further submitted that the case of this petitioner stands on better footing. Moreover, the petitioner is languishing in judicial custody since 31.01.2025 having no criminal antecedent.
6. Learned APP appearing for the state has opposed the prayer of regular bail.
7. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The petitioner no. 2 is directed to be released on bail in connection with Turkauliya P.S. Case No. 245 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two
