====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-12-2025 Heard learned counsel for the petitioner and learned APP for the State as also learned counsel for the O.P. No.2.

2. The petitioner is apprehending his arrest in connection with Purushottampur P.S. Case No. 43 of 2025 registered under Sections 126(2), 115(2), 118(1), 64, 62, 303(2), 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 8 of the POCSO Act.

3. As per allegation, on the alleged day of occurrence, the petitioner entered into the Informant's home, forced the Informant's minor daughter to remove her Salwar and tried to commit rape upon her on the point of knife.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.40672 of 2025(4) dt.03-12-2025 2/2 the present case. He further submits that the petitioner is a reputed teacher, who runs a coaching centre and none of the offences as alleged in the F.I.R. is made out against him.

5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

6.Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 7th cum Special Judge, POCSO, Bettiah, West Champaran, in connection with Purushottampur P.S. Case No. 43 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the B.N.S.S., 2023.

7. The petitioner will appear in the court below on each and every date fixed by the learned trial court till framing of the charge.
