Petitioner seeks bail in connection with Parsa P.S. Case No. 18 of 2017 registered under Sections- 366, 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that medical report goes to show that there was no sexual intercourse although in her statement under section 164 Cr.P.C victim has alleged that petitioner committed rape with her. The statement under section 164 Cr.P.C. is tutored one. The victim was recovered from the Dalan of co-accused Bikkey Kumar. Petitioner has no criminal antecedent and is in custody since 11.02.2017.
