2. The Petitioner apprehends his arrest in connection with Basantpur P.S. Case No. 696 of 2025, for the offences under Sections 126(2), 115(2), 118(1), 109, 352, 3(5) of B.N.S.

As per the prosecution case, which has been lodged on the basis of written report submitted by the informant to the effect that on the date of occurrence, while she was returning to her house after taking firewood, on way the petitioner along with other co-accused persons came and started hurling abuses. It has further been alleged that the petitioner assaulted on the head of the informant with a sword, causing injuries on her head. It has further been alleged that when the nephew of the informant came to rescue her, co-accused Vishal Kumar

2/4 assaulted on his head with an iron rod, due to which he sustained injuries and blood started oozing out. Subsequent thereto, co-accused Badri Prasad and Subash Prasad assaulted the informant with fist and slap.

4. The learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. He further submits that the entire allegation leveled in the first information report are totally concocted and baseless. The petitioner and the informant are co-villagers and there is a dispute in between the parties from before. The specific allegation of assault with a sword is there against the petitioner, due to which she received injury on her head, however the same is not supported by the injury report, which has been discussed in the impugned order passed by the learned Sessions Judge, Siwan, wherein the doctor found the injury to be simple in nature. He further submits that there is a delay of two days lodging the first information report and the same has not been explained by the informant. He submits that the petitioner has got a clean antecedent.

5. Per Contra, the learned APP for the State vehemently opposes the prayer for grant of bail to the petitioner and submits that there is serious allegation against the petitioner

3/4 of assaulting the informant on her head with a sword, due to which she sustained injuries.

Having considered the rival submissions and after going through the record, it appears that the specific allegation of assault on the head of the informant, with a sword is there on the petitioner. From perusal of the injury, which has been discussed in the order passed by the learned Sessions Judge, Siwan in A.B.P. No. 768 of 2026, it would transpire that the doctor opined the injuries to be simple in nature. Further, the petitioner has got a clean antecedent. Considering the above, let the petitioner, above named in the event of arrest/surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Siwan in connection with Basantpur P.S.

4/4 antecedent, the court concerned shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification. (Ritesh Kumar, J) shital/- U T
