Petitioner is facing accusations punishable under Section 498A IPC vide Complaint Case No.923(C) of 2011. It has been submitted that by order dated 7.7.2014, the bail was granted to the petitioner and notice was issued to the complainant.
It appears, no one has appeared on behalf of the complainant to oppose the prayer. Learned counsel further submits that the complainant has married with some other person. Be that as it may, considering the facts and circumstances of the case, in the event of arrest or surrender in the
Patna High Court Cr.Misc. No.27246 of 2014 (4) dt.16-07-2015 2/2 Court below within four weeks, the petitioner abovenamed is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arrah in Complaint Case No. 923(C) of 2011 (Tr. No. 3275 of 2011) subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions: (i) One of the bailers shall be the own/close family members of the petitioner.
(ii) Along with the bail bond, the petitioner shall produce a demand draft of Rs. 2,000/- as cost of litigation in favour of the complainant and/or deposit the same amount in the Nazarat of the Court and produce receipt thereof which the complainant shall be entitled to withdraw.
