JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 66/30(a)/38(1)/37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

Toddy was recovered from the shop of the petitioner.

Petitioner has stated on oath that he was not present at the spot at the time of recovery and petitioner has got no criminal antecedent.

Considering the facts and circumstances, let

Patna High Court Cr.Misc. No.21435 of 2017 (2) dt.03-05-2017 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna/Successor Court, in connection with Kotwali P.S. Case No.98 of 2017, with condition that petitioner shall file undertaking at the time of furnishing of the bail-bond before the Court-below that he would not indulge himself in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
