In this case, the petitioners are seeking anticipatory bail in connection with Simari P.S. Case No.114 of 2019, registered for the offence punishable under Sections 448, 341, 323, 325, 307, 354, 504, 506/34 of the Indian Penal Code and Section 4/8 of POCSO Act, 2012 Allegation against the accused persons including the petitioners is to have entered into the house of the informant in the name of playing Holi and tried to outrage the modesty of the daughter of the informant and on protest, they have assaulted him and his wife, due to which, they sustained injuries
Patna High Court CR. MISC. No.37051 of 2019(2) dt.18-06-2019 2/2 and they were admitted in the P.M.C.H. for treatment. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
