Heard the learned counsel for the petitioner and learned APP for the State.

At the outset, learned counsel for the petitioner has submitted that the anticipatory bail petition of the petitioner was rejected, vide order dated 08.04.2022 in Cr.Misc.No. 43438 of 2021, but he has renewed his prayer for anticipatory bail on the ground that on the date of occurrence his leg was fractured and he was hospitalized.

From perusal of the order dated 08.04.2022 passed in

Patna High Court CR. MISC. No.40388 of 2022(3) dt.24-08-2022 2/2 Cr.Misc. No. 43438 of 2021, it appears that the anticipatory bail petition of the petitioner was rejected by this Court on the ground that he is the direct assailant of one injured Md. Azimuddin by fire-arm and Md. Azimudding had sustained grievous injury. The plea of alibi was not taken at the earliest possible opportunity.

In view of aforesaid, the petitioner is directed to surrender before the court below and seek prayer for regular bail.

With these observations, the anticipatory bail petition stands disposed of.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
