The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 323, 332, 337, 338, 333, 353 and 342/504 of the Indian Penal Code.

The prosecution story, in brief, is that the petitioner along with his family members abused the police personnel and also assaulted them by pelting stones, causing injury to them, while the informant went to arrest the petitioner in connection with another case.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.08.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court Cr.Misc. No.50283 of 2016 (2) dt.21-11-2016 2/2 petitioner has falsely been implicated in the present case. General and omnibus allegation has been made against the petitioner. From perusal of the order of the Sessions Judge, Lakhisarai, passed in B.P. No. 526 of 2016, it appears that the Court below had rejected the prayer of the petitioner with an observation 'at this stage'. A further liberty was granted to the petitioner by the Sessions Judge by observing that if the charge sheet has already been submitted, the petitioner may renew his prayer for bail, after one month or after framing of the charge, whichever is earlier.

In the light of the aforesaid observation and the liberty granted to the petitioner by the Sessions Judge, Lakhisarai, the petitioner wants to withdraw the present application, so that he may renew his prayer for bail before the Sessions Judge, Lakhisarai in the light of liberty and observations made by the Sessions Judge.

Permission is accorded with aforesaid observation. The present application is disposed of.
