2. The petitioner seeks bail in connection with Shakurabad P.S. case No. 55 of 2024 instituted for the offences under Sections 341, 323, 324, 354B, 509 of the Indian Penal Code.

3. Prosecution case, in short, is that when the informant was returning home, the petitioner began to tease her. When the informant went to the house to complain to his mother, who was not present there, the petitioner closed the door and teased her and bite her on her cheek. On her cry, villagers assembled there and they pushed and shoved him due to which he sustained injuries on his head.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that allegation against the petitioner is false and concocted. Learned counsel further submitted that there is family dispute going on between the parties and, therefore, to save her skin at the behest of father and other family members, the informant has lodged the present case. Learned counsel has annexed a copy of FIR lodged by the mother of the petitioner against the family members of the informant (Annexure-2 to the present bail application) in support of the aforesaid submission. Learned counsel for the petitioner submitted that petitioner is a student with no criminal history and, therefore, learned counsel urged that the petitioner may be released on bail. It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.04.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, clean antecedent as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing

No.44422 of 2024(2) dt.27-06-2024 3/3 bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Shakurabad P.S. case No. 55 of 2024, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.

(III) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
