This is a petition for grant of regular bail for offence under Sections 323, 363 and 366 of the Indian Penal Code. The allegation is of forceful abduction of the victimgirl by the named accused persons on Scorpio vehicle. The petitioner was driver of the Scorpio vehicle as per the statement of the victim. Soon after the abduction, the said vehicle met with an accident and the victim was taken to hospital. She has stated under Section 164 of the Criminal Procedure Code that she does not want to go with the case due to her proposed marriage within two months.
Submission of the learned counsel for the petitioner is that abduction simplicitor is bailable and nothing more is alleged against any of the accused persons, including the petitioner.
Considering the allegation against the petitioner as well as the statement of the victim under Section 164 of the Criminal Procedure Code, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in
Patna High Court Cr.Misc. No.21453 of 2017 (3) dt.28-06-2017 2/2 connection with Wazirganj P.S. Case No. 451 of 2015 to the satisfaction of the Chief Judicial Magistrate, Gaya, or successor Court.
