Petitioner seeks regular bail who is in custody since 29.08.2022, in connection with ST No. 233 of 2023, arising out of Vidyapatinagar P.S. Case No. 19 of 2022, FIR dated 14.02.2022, registered for the offences punishable under Sections 363 and 366 read with Section 34 of the Indian Penal Code.

Earlier the petitioner has moved before this Hon'ble Court in Cr. Misc. No. 4693 of 2023, which was dismissed vide order dated 04.07.2023.

According to the prosecution case, while the informant was not at house, one Ritik Raj @ Harsh kidnapped

Patna High Court CR. MISC. No.42600 of 2024(3) dt.28-08-2024 2/3 his wife and daughter and also looted articles worth Rs. 3,00,000/- (Rupees three lakhs).

Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation levelled in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. In fact, he has not kidnapped the victim, rather she willingly came with the petitioner.

Vide order dated 18.07.2024, a report was called for with regard to the stage of the trial and report dated 26.07.2024 of the learned trial Court reveals that trial is going on and statement of the victim was recorded and she has fully supported the case of the prosecution.

Considering the aforesaid facts and circumstances, the report of the learned trial Court as well as the allegation levelled in the FIR against the petitioner, I am not inclined to enlarge the petitioner on bail in connection with Vidyapatinagar P.S. Case No. 19 of 2022, pending in the Court of learned Additional Sessions Judge, Dalsingsarai, Samastipur. 8.

Prayer is refused.

However, the learned trial Court is directed to
