The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and case of the prosecution is that the son of the informant was killed and his dead body was found hanging from a tree in the field. The informant has suspected the hands of the petitioner and others with whom she had litigation from before.
Learned counsel for the petitioner submits that an absolute false case has been lodged against the petitioner and that too only on the basis of suspicion, it is next submitted that

No.42001 of 2022(2) dt.12-12-2022 2/2 even during the course of investigation no material has come to connect the petitioner with the offence, it is further submitted that six of the accused persons similarly situated like the petitioner have been granted anticipatory bail by learned coordinate Benches of this Court as would be evident from Annexure-2 series to the anticipatory bail application. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Madhuban P.S. Case No. 168 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
